EU Parliament votes for Article 11, Article 13 and Article 17: What's next?

There have been numerous in the last few weeks and months Protest against the upcoming EU copyright reform. To be more precise, they wanted to prevent the resulting upload filter with Article 13 or Article 17. Today the EU Parliament voted in favor of it with a majority.

Today the vote on Article 13 took place in the EU Parliament. There was probably so much onslaught that even the live stream collapsed in the end. The result is now known and is very sobering: the copyright reform is through.

74 votes too many: majority for Article 13

Specifically, 348 politicians voted in favor, 274 against and 36 politicians abstained, i.e. voted neutrally. However, this was not just the only vote on the EU copyright reform. At first the politicians didn't even really know what exactly they were going to vote on.

There was even a request to change the article, which was just as narrowly rejected. Only 5 votes were decisive here. More precisely, 312 politicians voted for an amendment, 317 against and 24 abstained. Thus there will be no change to the EU copyright reform.

What is changing now?

With Article 13, every platform on which user-generated content can be uploaded is liable for the published content. Thus, the individual platforms have to check which content is exactly being uploaded. For this procedure, an "upload filter" will probably be used, which precisely analyzes uploaded images and videos using an algorithm.

Demos did nothing?

Last weekend, in addition to hundreds of thousands of people in Germany alone, many other demonstrators were on the street and have demonstrated against the EU copyright reform. Didn't these demos work? Apparently not. That ProAnother problem is probably the lack of understanding on the part of the politicians in the EU Parliament – ​​some of them are much too old to know exactly what this is about and throw wild speculation about it. For example, politicians said about the upload filter: "The platforms will manage it."

However, it is not only about the big ones like YouTube, Facebook or Instagram. How is a forum operator supposed to be able to install such a filter? However, he must check this content, otherwise he will infringe copyrightproproblem can be held liable.

What can you do now?

The vote cannot be changed now. Those of you who are also against Article 13 must exercise their right to vote in the upcoming European elections on May 26, 2019 and not vote for politicians or parties that voted for it.

Before Article 13 is actually implemented, there are probably still numerous questions to be clarified. In general, the question is: How do you really do that? No one can currently answer this question in practice - apart from theoretical statements.
